Terms of Use

By downloading, installing, or using Aktify ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legal agreement between you and Mysticbits Oü ("we", "us", "our") regarding your use of Aktify.

Aktify is a productivity application designed for Apple Vision Pro, iPhone, and iPad. You may use the App for personal and commercial productivity purposes in accordance with these Terms.

You agree not to:

• Reverse engineer, decompile, or disassemble the App

• Use the App for any unlawful purpose

• Attempt to gain unauthorized access to any systems or networks connected to the App

• Redistribute, sublicense, or resell the App outside of Apple's ecosystem

• Interfere with or disrupt the integrity or performance of the App

Aktify, including its design, code, visual elements, animations (including the Swirl), branding, and all related intellectual property, is owned by Mysticbits Oü. All rights reserved.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App on your Apple devices, subject to the Apple Media Services Terms and Conditions.

The Aktify name, logo, and associated branding are trademarks of Mysticbits Oü. You may not use these without our prior written consent.

Any content you create within Aktify (tasks, focus sessions, settings, and other data) remains yours. We do not claim ownership over your content.

Your data is stored locally on your device and synced via Apple's CloudKit to your personal iCloud account. Mysticbits Oü does not have access to your personal data. We cannot read, modify, or delete your content.

You are responsible for maintaining backups of your data through iCloud or other means.

Aktify may offer subscription-based features. All subscriptions are processed and managed through the Apple App Store.

• Billing: You will be billed through your Apple ID account at the confirmation of purchase

• Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period

• Management: You can manage or cancel subscriptions in your device's Settings → Apple ID → Subscriptions

• Refunds: Refund requests are handled by Apple in accordance with their refund policies

Prices may change with notice. Any price changes will apply to the next renewal period.

Aktify is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. We are not responsible for any data loss resulting from your use of the App.

To the maximum extent permitted by applicable law, Mysticbits Oü shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or use, arising out of or related to your use of the App.

Our total liability to you for any claims arising from your use of the App shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.

You may stop using Aktify at any time by uninstalling the App from your devices.

We reserve the right to suspend or terminate your access to the App if you violate these Terms. Upon termination, your right to use the App ceases immediately.

Sections relating to intellectual property, disclaimers, limitations of liability, and governing law survive termination of these Terms.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Mysticbits Oü is incorporated, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the App shall be resolved through good-faith negotiation first. If negotiation fails, disputes shall be resolved in the courts of the applicable jurisdiction.

We may update these Terms from time to time. When we make changes, we will update the "Effective Date" at the top of this page.

Continued use of the App after changes are posted constitutes your acceptance of the revised Terms. For material changes, we may provide additional notice through the App or our website.
